General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (hereinafter "GTC") govern all contracts between Fluxseron GmbH, Masanserstrasse 197, 7000 Chur, Switzerland, UID: CHE-335.498.211 (hereinafter "Seller" or "LuniVault") and its customers (hereinafter "Customer").

The online shop is exclusively for natural persons residing in Switzerland or the Principality of Liechtenstein.

Deviating terms and conditions of the Customer are not recognized unless the Seller expressly agrees to them in writing.

2. Contract Language

All legal transactions, correspondence, and contract documents are conducted in German.

3. Offer and Conclusion of Contract

The product representations in the online shop do not constitute a binding offer, but an non-binding invitation to order.

By submitting the order, the Customer makes a binding offer to purchase. The contract is concluded when the Seller accepts this offer by an order confirmation via email or by shipping the goods.

Should a product not be available, even though it was displayed in the shop, the contract cannot be concluded regarding this product. The Customer will be informed, and any amounts already paid will be refunded.

4. Prices and Payment Terms

All prices are in Swiss Francs (CHF) including statutory value-added tax. Shipping costs are shown separately.

Accepted payment methods:

• TWINT
• Credit Card / Shop Pay
• PayPal

The invoice amount is due immediately upon conclusion of the contract.

The Seller reserves the right to restrict certain payment methods or to demand additional securities.

5. Delivery and Shipping Terms

The delivery area is Switzerland and the Principality of Liechtenstein.

Shipping costs are a flat rate of CHF 7.90 per order. For orders with a value of CHF 129.– or more, delivery is free of charge.

Shipping is carried out by the Swiss Post via A-Post. The shipping method (package or small goods shipment) is determined depending on the size, weight, and value of the ordered products. There is no entitlement to a specific shipping method.

If shipping is done as a package, tracking will be provided.

Partial deliveries are permissible, provided they are reasonable for the customer. Additional shipping costs will not be charged in this case.

The stated delivery times are non-binding unless they have been expressly guaranteed in writing as binding.

The Customer is obliged to inspect the goods immediately upon receipt and to report recognizable defects in writing within 5 days.

6. Pre-orders

Products marked as "Pre-order" will only be shipped after official release and availability.

Information regarding release dates is non-binding and may change due to manufacturer delays.

For limited pre-orders, the allocated delivery quantity may be reduced if suppliers or manufacturers reduce quantities or make partial deliveries.

LuniVault may adjust, reduce, or cancel order quantities if delivery quantities are unavailable. Amounts already paid will be refunded in such a case. There is no entitlement to the delivery of specific quantities.

7. Quantity Restrictions, Resale, and Hype Products

LuniVault may set quantity limits per customer. Orders exceeding these limits may be reduced or canceled.

Purchases are generally intended for private use. Commercial resale is not permitted without the express written consent of LuniVault.

8. No Voluntary Right of Withdrawal

There is generally no right of withdrawal or return, except for legally mandatory claims for defects.

A return without defect or transport damage will not be accepted.

9. Warranty

The statutory warranty rights apply to defective products. The Seller may, at its discretion, offer replacement, repair, credit, or refund.

A prerequisite is the timely, written notification of a defect immediately upon receipt.

Normal wear and tear as well as improper handling or damage are excluded from the warranty.

10. Liability

The Seller is only liable for intentional or grossly negligent breaches of duty. Further liability for indirect damages, consequential damages, lost profits, or data loss is excluded, to the extent permitted by law.

Liability for products not manufactured by the Seller themselves is governed by statutory provisions.

11. Retention of Title

The delivered goods remain the property of the Seller until full payment.

12. Data Protection

Fluxseron GmbH processes personal data for contract processing and to fulfill legal obligations. Disclosure to logistics partners or payment service providers is permitted to the extent necessary for contract fulfillment. Further details are regulated in the privacy policy.

13. Copyright / Content

All content of the shop (texts, images, logos, graphics, software, etc.) is protected by copyright and may not be used without consent.

14. Severability Clause

Should individual provisions of these GTC be invalid or ineffective, the validity of the remaining provisions remains unaffected.

15. Place of Jurisdiction and Applicable Law

Swiss law applies exclusively. The place of jurisdiction is Chur, Switzerland.
